2. Agreement to Terms

By accessing or using Still You ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to:

• The Still You mobile application for iOS (available on Apple App Store)
• The Still You mobile application for Android (available on Google Play Store)
• The Still You website (stillyou.app)
• All related services, features, and content

2.1. Mobile App Distribution

The Still You mobile app is distributed through:

• Apple App Store — governed by Apple's Licensed Application End User License Agreement
• Google Play Store — governed by Google's Terms of Service

By downloading our app, you also agree to the terms of the respective platform. In case of conflict between these Terms and platform terms, platform terms take precedence for matters specific to distribution and payment.

3. Important Medical Disclaimer

PLEASE READ THIS SECTION CAREFULLY BEFORE USING STILL YOU

3.1. Not Medical Advice

Still You is a wellness and relaxation application. It is NOT a medical device, therapy, or treatment. The content provided — including meditations, breathing exercises, hypnosis sessions, and affirmations — is for general wellness and relaxation purposes only.

3.2. Not a Substitute for Professional Care

The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It is not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider or mental health professional.

3.3. Breathing Exercise Warnings

Breathing exercises may cause dizziness, lightheadedness, hyperventilation, or altered states of consciousness. Do NOT perform breathing exercises:

• While driving or operating machinery
• In or near water
• While standing (risk of falling)
• If you have a history of seizures or epilepsy
• If you have cardiovascular conditions
• If you are pregnant (without medical approval)

3.4. Hypnosis and Guided Meditation Warnings

Hypnosis and deep meditation content may induce relaxed or altered states of consciousness. Use only in safe environments. Do not use while performing activities requiring full attention.

3.5. Pre-existing Conditions

If you have any of the following conditions, consult your healthcare provider before using Still You:

• Mental health conditions (depression, anxiety disorders, PTSD, psychosis)
• Epilepsy or history of seizures
• Heart conditions or cardiovascular disease
• Respiratory conditions (asthma, COPD)
• Pregnancy
• Any condition that may be affected by relaxation techniques

3.6. Use at Your Own Risk

You acknowledge that you use Still You entirely at your own risk. You are solely responsible for your own health and safety when using the Service. If you experience any adverse effects, discontinue use immediately and seek professional medical help.

3.7. Emergency Situations

If you are experiencing a medical or mental health emergency, stop using the app and contact emergency services immediately. Still You is not an emergency service and cannot provide crisis intervention.

3.8. AI-Generated Content Disclaimer

Some features of Still You, such as the Goblin Deconstructor, use artificial intelligence (AI) to generate content. This AI-generated content:

• Is provided for guidance and convenience only
• Is not professional, medical, or therapeutic advice
• May contain errors, inaccuracies, or unsuitable suggestions
• Should be reviewed and adapted by you before use

We are not responsible for the accuracy, completeness, or suitability of AI-generated content. You use AI features entirely at your own discretion and risk.

4. Eligibility

You must be at least 16 years old to use Still You. By using the Service, you represent and warrant that you meet this age requirement.

If you are between 16 and 18 years old (or the age of majority in your jurisdiction), you represent that you have obtained parental or guardian consent to use the Service.

5. Account Registration

To access certain features (especially Premium content), you may need to create an account. You can register using:

• Email and password
• Sign in with Apple (iOS)
• Sign in with Google

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or are suspected of fraudulent activity.

6. Subscription and Payments

6.1. Freemium Model

Still You operates on a freemium model:

• Free tier: Access to a limited selection of meditations, breathing exercises, and basic features — no account required
• Premium tier: Full access to all content, including exclusive meditations, hypnosis sessions, sleep stories, and advanced features — requires a paid subscription

6.2. Premium Subscription

Premium subscriptions are available on a monthly or annual basis. Subscription details:

• Billed in advance on a recurring basis (monthly or annually)
• Auto-renewal: Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period
• Prices are displayed in your local currency as determined by Apple or Google
• Your subscription is tied to your App Store/Google Play account

6.3. Payment Processing

All payments for in-app purchases are securely processed by:

• Apple App Store — for iOS users (via Apple's In-App Purchase system)
• Google Play Store — for Android users (via Google Play Billing)

We use RevenueCat as our subscription management platform to:

• Verify your subscription status across devices
• Sync your Premium access between iOS and Android (using the same account)
• Manage entitlements and subscription events

We never access or store your payment card information. All financial transactions are handled directly by Apple or Google according to their respective terms.

6.4. Free Trial

If you sign up for a free trial:

• You will have access to Premium features during the trial period
• You will be charged at the end of the trial period unless you cancel before it ends
• Cancellation instructions are available in the App and in your App Store/Play Store account settings

6.5. Cancellation

You can cancel your subscription at any time:

• iOS: Settings → Apple ID → Subscriptions → Still You → Cancel
• Android: Google Play Store → Menu → Subscriptions → Still You → Cancel

After cancellation, you will retain access to Premium features until the end of your current billing period.

6.6. Refunds

Refunds are handled according to the policies of Apple or Google:

• Apple App Store: Request a refund from Apple
• Google Play Store: Request a refund from Google Play

We do not process refunds directly. Please contact Apple or Google support for refund requests.

6.7. Price Changes

We may change subscription prices from time to time. Price changes will not affect your current billing period and will be communicated in advance. Continued use after a price change constitutes acceptance of the new price.

7. Acceptable Use

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to reverse engineer, decompile, or hack the App
• Share your account credentials with others
• Use the Service for any commercial purpose without permission
• Upload malicious code, spam, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Record, redistribute, or commercially exploit our content

8. Mobile App Features

The Still You mobile app includes the following features that require additional consent or awareness:

8.1. Push Notifications

We use OneSignal to deliver push notifications. These may include:

• Meditation reminders you set
• New content announcements
• Personalized recommendations
• Important account notifications

You control notifications:

• iOS: Settings → Notifications → Still You
• Android: Settings → Apps → Still You → Notifications

You can enable or disable notifications at any time. We respect your preferences — no guilt, no pressure. Come back when you're ready.

8.2. Error Monitoring and Analytics

To improve app stability and your experience, we use:

• Sentry — captures crash reports and performance data to help us fix bugs quickly. No personal data is included in crash reports.
• AppsFlyer — helps us understand how users discover our app (attribution). Uses device identifiers with your consent.

8.3. Background Audio

Still You requests permission to play audio in the background so you can:

• Continue listening to meditations when the screen is off
• Play sleep stories while your device is locked
• Use breathing exercises with audio guidance hands-free

8.4. Offline Access

Premium subscribers may download content for offline use. Downloaded content:

• Is stored locally on your device
• Remains accessible only while your subscription is active
• May be removed automatically if your subscription expires

9. Intellectual Property

All content in Still You — including but not limited to audio recordings, meditations, music, text, graphics, logos, icons, and software — is owned by Marcin Tobala Digital Media or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9.1. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only.

9.2. Restrictions

You may NOT:

• Copy, reproduce, or distribute our content
• Create derivative works from our content
• Remove any copyright or proprietary notices
• Use our trademarks without written permission

10. Account Deletion

You have the right to delete your account at any time. You can do this by:

• Using the account deletion feature in the App (Settings → Account → Delete Account)
• Sending a request to contact [at] stillyou.app

• Your active subscription will be cancelled (you will not be charged for future periods)
• This action is irreversible

Note: Some data may be retained as required by law (e.g., invoices for tax purposes).

11. Limitation of Liability

To the fullest extent permitted by applicable law:

11.1. No Warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.2. Exclusion of Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruptions or technical issues
• Damages arising from your use or inability to use the Service
• Any health-related issues or adverse effects experienced while using the Service

11.3. Maximum Liability

Our total liability to you for any claims arising from or relating to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or €50 (whichever is greater).

11.4. Health Liability Exclusion

You expressly acknowledge and agree that we are not liable for any physical, mental, or emotional effects — whether positive or negative — that may result from using the meditation, breathing, hypnosis, or other content in Still You.

12. Indemnification

You agree to indemnify, defend, and hold harmless Marcin Tobala Digital Media, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any health-related claims arising from your use of the Service

13. Governing Law and Disputes

If you are a resident of the United States, these Terms are governed by the laws of the State of California, without regard to conflict of law principles.

13.3. For Users in Other Jurisdictions

For users outside the EU and USA, these Terms are governed by the laws of Poland. Any disputes shall be resolved by the competent courts in Kraków, Poland.

14. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is fraudulent or illegal

You may terminate at any time.

Certain provisions survive termination.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through:

• Posting a prominent notice in the App
• Sending an email to the address associated with your account
• Updating the "Last Updated" date on this page

Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree with the changes, you must stop using the Service and delete your account.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Still You sp. z o.o. regarding the App.
